What are the eligibility requirements for a solo 401(k)?
To qualify for a solo 401(k), you must have self-employment income and no full-time employees other than a spouse who works in the business. This includes sole proprietors, freelancers, consultants, partnerships, and owner-only corporations. Independent contractors do not count as employees, but if you hire eligible employees, you generally can no longer maintain a solo 401(k).
These plans follow the same rules as standard 401(k) plans, but they are limited to businesses that do not have common-law employees who would otherwise need to be included in the plan.
